A landlord secures an anchor tenant with a big-name, stable, and successful chain store. The landlord negotiates that a percentage of this successful tenant's gross sales out of the landlord's location will constitute a portion of the rental payments. In order to protect his percentage rent, the landlord ensures that the lease contains a provision that (it thought) would forbid the tenant from opening another store in close proximity to the landlord's property. Therefore, the landlord has sufficiently guaranteed not only a base rental payment, but also a portion of the tenant's success, and it is confident the tenant will be very successful in the area. The landlord is thrilled, right? Maybe not. New case law indicates that courts may interpret the landlord's lease provision protecting against a new store, a radius clause, in a manner different from the way the landlord had intended.

In the wake of the demise of Arthur Andersen following the partnerships' indictment by the federal government, prosecutors are increasingly pressuring corporations to enter into deferred-prosecution agreements (DPAs) to avoid ' at least temporarily ' full-blown criminal prosecutions. While these agreements may seem to offer an attractive option to embattled companies faced with the prospect of a lengthy and potentially devastating criminal prosecution, the freedom with which the individual prosecutors operate when crafting the agreements should cause concern.

The glass ceiling is alive and well in America's 200 largest law firms. According to a survey released last October by the National Association of Women Lawyers (NAWL), women make up a paltry 16% of equity partners, 16% of governance committee members and 5% of managing partners in these firms. NAWL says the firms should double the number of women equity partners and corporations should reach the same target with chief legal officers by 2015. Even so, the percentage of women in equity and leadership roles in the legal profession would still fail to reflect that women now represent about 50% of all law school graduates. <br>Do women attorneys have a particular need for communication skills development? Yes.
