Wyoming Recognizes 'Loss of Chance' Cause of Action
In a case of first impression, the Supreme Court of Wyoming has recognized a cause of action for loss of last chance for survival. McMackin v. Johnson County Healthcare Center, No. 01-214, 2003 WY 91; 2003 Wyo. LEXIS 112, Sup. Ct. of Wyoming (8/1/03).
Plaintiff, the daughter of Harriette R. Brown, a woman who died at a nursing home, appealed from a partial summary judgment entered by the District Court of Johnson County, WY, in favor of defendant health care providers on the issue of whether their alleged negligent care was a cause of the patient's death.
