Protecting Product Liability Clients in the Event of an Avian Flu Pandemic

Recent news reports have brought international attention to the dramatic risks associated with a worldwide outbreak of the avian H5N1 virus flu. Although the legal issues that may arise as a result of a pandemic are not all necessarily product liability issues, attorneys with a focus on product liability law are well advised to consider how such a pandemic might affect their clients and potential clients. It is also prudent for product liability attorneys to consider now what can be done to prepare for the worst case scenario.

Background on Avian Flu

The possibility of an avian flu pandemic is so significant that the U.S. government has developed a Web site dedicated solely to informing the public on issues related to the avian flu (www.pandemicflu.gov). That site notes that the public health community fears that the continued expansion of the highly pathogenic avian H5N1 virus across eastern Asia and other countries represents a significant threat not only to poultry, but to human health as well. The H5N1 virus raises special concerns among public health professionals about a potential human pandemic because: 1) the virus is especially virulent; 2) it is being spread by migratory birds; 3) it can be transmitted from birds to mammals and potentially from human to human; and 4) like other influenza viruses, it continues to evolve.
