Electronic Health Information Legislation Moves Forward
On July 27, Congress approved an amended version of Senate Bill 1418 that aims to move the country's health care medical records from paper to computer. House Bill 4157 differs from the Senate's version in that it calls for current medical privacy laws to apply to the new data storage format and asks the secretary of the Department of Health and Human Services to recommend to Congress a method for coordinating state and federal privacy laws.
David Sloane, Director of Govern-ment Affairs at the Association for the Advancement of Retired Persons (AARP), lauded the intent behind the bill but expressed concern that it did not go far enough to protect the confidentiality of medical records. Said Sloane in an AARP release, 'Fear of data breaches and misuse could cause patients to withhold information or forgo treatment. Patients need to be able to control and review how their personal information is shared. They also need to be notified and afforded recourse if their privacy is breached. Congress needs to act soon to give patients the privacy protections they need and deserve if it is truly serious about Health IT.'
