Husband Wins $6 Million in Med-Mal Trial
The husband and estate of a woman who developed blood clots and died shortly after undergoing outpatient knee surgery were awarded more than $6 million by a Georgia court in November. Quarles v. McKenzie, No. SU06CV264-8 (Muscogee County Superior Court (GA), 10/20/09).
The deceased, Ruby Nicole Quarles, was 42 years old when she sought help from a surgeon, Dr. Colin S. McKenzie. He ordered an MRI to determine whether Quarles might have a tear in the cartilage of her knee. The MRI indicated a “cartilaginous loose body” behind Quarles' knee. She underwent arthroscopic surgery, which took less than an hour. Dr. McKenzie did not find any loose cartilage or other damage, however, and Quarles was sent home that same afternoon. By noon the following day Quarles had died. An autopsy showed that deep venous thromboids had formed at the site of the surgery and traveled to Quarles' lung, causing a pulmonary embolism.
