U.S. Judge Tosses Qui Tam Action Against Lockheed Martin

A federal judge has dismissed a qui tam case in which would-be whistleblowers raised allegations that aerospace giant Lockheed Martin billed the government for cost overruns and failed to disclose shoddy work.

U.S. District Judge Kim R. Gibson of the Western District of Pennsylvania gave one of the two relators leave to file an amended complaint, leaving the door open for further action in the case.

Gibson said that while any amendment to the complaint was “likely futile” in overcoming the shortcomings of the case, the law favored giving that relator opportunity to try again.

The suit was filed by plaintiffs Holly Thomas, a former purchasing assistant at Lockheed Martin Aeroparts who went on medical leave and did not return, and Michael Meketa, a former auditor at the company who was laid off. Thomas was dismissed from the litigation because she and Lockheed reached a settlement in a separate Americans with Disabilities Act (ADA) litigation that released the company from all other claims.
